flyBy legal (terms of use)

Effective date: September 23, 2026.

These terms cover the flyBy iOS app and https://playflyby.com (the “Services”). By downloading, installing, accessing, or playing flyBy, or by using the website, you agree to these terms. If you do not agree, do not use the Services.

1. What flyBy is

flyBy is an entertainment video game for iPhone. Features may include Classic flight, Arcade Mode (optional perks such as machine gun, laser, ghost, and spare life), themes and characters, optional rewarded continue ads, optional Apple Game Center leaderboards, and optional local device reminders. Features can change with app updates.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use flyBy for your own entertainment on devices you own or control, subject to these terms and Apple’s App Store rules. You may not sell, rent, redistribute, or publicly perform the app except as Apple’s rules allow (for example personal gameplay video).

3. No flyBy account

There is no flyBy player account and no flyBy sign-in required to play. Optional Apple services (App Store purchases, Game Center, iCloud-backed Apple features if Apple enables them) are governed by Apple’s terms.

4. Purchases and virtual items

• Optional in-app purchases are non-consumable unlocks (themes, characters, bundles, upgrades, No Ads) sold through Apple. Prices appear on Apple’s purchase sheet.
• Payment, billing, taxes, and refunds for App Store purchases are handled by Apple under Apple’s terms. Contact Apple for refund requests.
• Restore purchases is available in the in-app store. Reinstalling the app does not remove valid Apple entitlements when you restore.
• Unlocks have no cash value, are not redeemable for money, and are licensed, not sold, for use in flyBy.
• We do not promise that any particular item, mode, or price will remain available forever.

5. Ads

Unless you own No Ads, a rewarded video may appear after a flight when you choose continue. Ads are provided by Unity Ads or other partners we may use later. Ad content is controlled by the ad network. Use Report ad on the death screen for inappropriate ads. Completing an ad is required for the continue reward; closing early grants nothing.

6. Game Center and scores

Leaderboards and related Game Center features are optional and run through Apple. Cheating, bots, score manipulation, or abuse of Game Center may lead to score removal, feature disablement, or other action we or Apple take. Competitive rankings are entertainment only.

7. Notifications

If you allow notifications, flyBy may schedule local on-device reminders. You can revoke permission in iOS Settings at any time.

8. Website and lab

playflyby.com is for information, privacy/legal/support, and marketing. The optional /lab playtest is a browser build that may differ from the App Store version, may break, and is provided as-is for testing. Do not rely on /lab as the official shipped game.

9. Acceptable use

You agree not to:

• Hack, reverse engineer (except where law allows), modify, or create unauthorized derivative works of the Services
• Use cheats, automation, exploits, or third-party tools that interfere with fair play or servers/services we or Apple operate
• Attempt to disrupt the Services, other players, or Apple/Game Center systems
• Use the Services for illegal activity, harassment, or to infringe others’ rights
• Misrepresent affiliation with flyBy or scrape the site in a way that harms availability

10. Intellectual property

flyBy name, game art, audio, code, UI, and related materials are owned by the publisher or its licensors. Apple, the Apple logo, App Store, and Game Center are trademarks of Apple Inc. Unity is a trademark of Unity Technologies. Other marks belong to their owners. No trademark license is granted except as needed to identify the Services.

11. Third-party services

The Services depend on Apple (App Store, StoreKit, optionally Game Center and device OS features) and may use Unity Ads or other providers. Their terms and privacy policies apply to their services. We are not responsible for third-party outages, policy changes, or content (including ads).

12. Age and parents

You must be allowed under applicable law to use the App Store and make (or have a parent/guardian make) any purchases. flyBy is not directed to children under 13 and is not in Apple’s Kids Category. Parents should supervise device use, Game Center, ads, and spending.

13. Health and safety

Take breaks. Stop if you feel eye strain, dizziness, or discomfort. flyBy is not a medical, fitness, or training product. Gameplay intensity (including Arcade Mode) is for entertainment only.

14. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free play, that scores will be preserved forever, or that ads or third-party features will always be available.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY FOR FLYBY IN THE 12 MONTHS BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID TO APPLE), OR (B) USD $10. Some places do not allow certain limits; in those places our liability is limited to the fullest extent allowed.

16. Indemnity

You will defend and indemnify the publisher against claims arising from your misuse of the Services or your breach of these terms, to the extent allowed by law.

17. Termination

You may stop using the Services at any time (uninstall / leave the site). We may suspend or end access to website features or withhold support for abuse or material breach. App Store access is also subject to Apple’s rules. Sections that by nature should survive (including IP, disclaimers, limits, indemnity) survive termination.

18. Changes

We may update these terms. The effective date will change when we do. Continued use after posting means you accept the updated terms. Material purchase or privacy changes will also be reflected in the privacy policy where required.

19. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, except where mandatory consumer laws in your place of residence say otherwise. Exclusive venue for disputes that may be brought in court is the state or federal courts located in Florida, except where law requires otherwise. Nothing here limits rights you cannot waive as a consumer.

20. Apple-required notice (App Store)

You acknowledge that these terms are between you and the flyBy publisher, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for flyBy. In the event of any failure of flyBy to conform to an applicable warranty, you may notify Apple, and Apple may refund the App Store purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for flyBy. Apple is not responsible for addressing claims relating to the app or your possession/use of it, including product liability, legal/regulatory failure, consumer protection, or intellectual property claims. Apple and Apple’s subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
